BETHESDA, Md.--(BUSINESS WIRE)--Sept. 16, 2003--The U.S. Court of International Trade today affirmed the U.S. Department of Commerce's (DOC) determinations on two of three general issues in the trade cases covering imports of European low-enriched uranium (LEU). The court affirmed the DOC's determination that USEC constitutes the domestic industry, with standing to file these cases. The court further affirmed the DOC's determination that enrichment contracts are covered by countervailing duty law. Finally, the court appeared to reverse the DOC's decision relating to DOC's antidumping duty order, though the full impact of this aspect of the decision is not yet clear.
While we are still reviewing the decision, we remain confident that the ultimate outcome in these cases will be favorable to USEC. The court's decision is another step in an ongoing process of decision and appeal. Nothing changes; all countervailing and antidumping duties remain in effect until the U.S. Court of Appeals for the Federal Circuit finally rules on these appeals.
